CITY OF WOODLAND PARK NOTICE OF PUBLIC HEARING

 

Public Hearing on Ordinance No. 1406, Series 2021, shall be held via zoom and in person, on the 21st day of October at 7:00 PM. The aforesaid Ordinance was posted on the City’s website October 11, 2021 prior to the City Council meeting, passed on first reading, and ordered published, as required by Section 7.6 of the Charter of the City of Woodland Park.

CITY OF WOODLAND PARK, COLORADO

ORDINANCE NO. 1406, SERIES 2021

An ordinance vacating THAT PORTION OF THE ALLEY BETWEEN lOTS 6-7, bLOCK 6, lAKE aDDITION TO THE TOWN OF WOODLAND PARK AND LOT 4, BLOCK 6, ELM HEIGHTS

 

            WHEREAS, the City Council, after public hearing with notice as required by law, finds that it is in the best interest of the citizens of the City of Woodland Park to grant the requested vacation; and

 

            WHEREAS, no land adjoining the public alley right-of-way requested to be vacated would be left, by reason of this vacation, without an established public road or public access easement connecting said land with another established public road.

 

NOW, THEREFORE, THE CITY OF WOODLAND PARK, COLORADO, ORDAINS:

 

            That the Ordinance entitled “AN ORDINANCE VACATING THAT PART OF THE ALLEY BETWEEN LOTS 6-7, BLOCK 6, LAKE ADDITION TO THE TOWN OF WOODLAND PARK AND LOT 4, BLOCK 6, ELM HEIGHTS,” be and is hereby adopted as follows:

Section 1.  The portion of the alley labeled Parcel A as shown in Exhibit A and legally described in Exhibit B is hereby vacated by the City of Woodland Park.

Section 2.  Title to the entirety of Parcel A, by agreement of all involved parties, shall vest with Lot 4, Block 6, Elm Heights.   

Section 3.  There is hereby reserved by and to the City: 

  1. a 15’ wide public access easement for ingress and egress in, across, over, through and under Parcel A; and
  2. a 15’ wide utility easement in, across, over, through and under Parcel A. The City may assign an interest in such utility easement as appropriate to a utility service provider as the need arises. 

Section 4.  This Ordinance shall be in full force and effect from and after its publication as required by law.
